NHS and public service pension advice update

Updated advice is available to members about the McCloud age discrimination remedy.

The McCloud remedy presents additional options regarding your NHS pension, but also leaves the potential for needing extra advice. In many cases it represents a positive outcome, offering higher pension benefits. 

The McCloud remedy will apply to anyone who was a member of the NHS pension scheme before 1 April 2012 or contributed to the NHS pension scheme at any time between April 2015 and March 2022 (referred to as the remedy period). 

During the remedy period members built up pensions in different NHS pension schemes, but differential treatment was applied on the grounds of age which was later deemed to be age discriminatory. The McCloud remedy has been put in place to resolve this issue. 

Our advice gives a brief introduction to the McCloud remedy and provides more information on how it will work. Our current advice applies to England and Wales only with Scotland and Northern Ireland expected to adopt similar provisions soon. We will keep you updated on any further changes.
